EHDS Regulations
European Health Data Space (EHDS) — what it is, why it matters, and how Firely can help
EHDS Regulations
The European Health Data Space (EHDS) is a major new European Union regulation designed to transform how health data is accessed, exchanged, and used across the EU.
This regulation will have an impact on health applications, national health data exchange networks, and healthcare providers. The initial deadline has been defined for March 2029, so you could be tempted to shrug your shoulders and take a ‘wait and see’ attitude. However, that may not necessarily be the best idea.
EHDS implementation timeline — what’s set so far
Even though many practical details are still under development, the broad timeline for the rollout of EHDS is already defined in the regulation:
March 26, 2029
The first major set of EHDS rules start applying across the EU in March 2029. Patients must be able to digitally access and share key health data (in the patient summaries and e-prescriptions priority categories) across borders by this date. EHR software put on the market after this date that handle these priority data categories must comply with EHDS technical and interoperability requirements.
The framework for secondary use of healthcare data (for research, innovation, public health, and policymaking under strict governance) also becomes operational, meaning national authorities and data access bodies must be ready to grant and manage lawful access to healthcare data.
Software vendors with applications that are already well established on the market prior to March 2029 are impacted by the implicit requirements of the EHDS regulation: the requirement on the member states to make all of a patient’s data available through a centralized portal implies that software applications have to make such data available; the right of a patient to correct their data implies that the software applications holding such data need to have the functionality to support requests for corrections. Vendors of applications put on the market may well choose to adopt the EHDS technical specifications, for marketing reasons, at the request of a customer, or because of member state legislation.
March 26, 2031
Additional provisions become applicable to priority health data categories such as medical imaging, test results and discharge reports will need to meet EHDS requirements. At the same time, further secondary-use rules for health data (for research, innovation, public health and policy) become operational.
Beyond 2031
The regulation specifies that new priority health data categories (such as immunization data) may be added after the March 2026 deadline. Evaluation cycles and potential future adjustments will be driven by the Commission and Member States.
Why organizations need to prepare now
EHDS is not simply a future policy to comply with when the dates finally arrive — it’s a structural shift in how health data will be governed and exchanged in Europe. Several aspects are already clear:
Interoperability specifications will be mandatory. The regulation aligns with EU-wide frameworks such as the European Electronic Health Record Exchange Format (EEHRxF), and standards like FHIR will play a central role. Detailed specifications for data access services, data formats, value sets, use of the EU Digital Wallet (EUDIW), consent/opt-out mechanisms and secure infrastructure are being prepared through implementing acts.
Governance bodies (Digital Health Agency and Health Data Access Bodies in each Member State) will oversee secure access to primary/secondary use of health data.
Because many of these specifics are still under negotiation and will only be finalized over the coming months and years, organizations can’t wait for final texts to begin thinking about EHDS compliance and strategic alignment.
Start planning for the EHDS – even before all details are finalized
Even though not all implementing acts and technical specifications are yet published, Firely is already working with European healthcare organizations to prepare for EHDS. Healthcare organizations and application vendors can’t afford to wait – the lead time to implement its requirements may well exceed the time that’s left before the March 2029 requirements apply.
Understand the Regulatory Landscape
Assess the EHDS scope and impact on your organization and applications. We can support your efforts by leveraging our expertise when it comes to European regulations.
Gap analysis & technical planning
Determine where your organization’s data formats, APIs, consent management, metadata and EHR connectors currently stand, and what your roadmap should look like to meet EHDS-era requirements – well before final rules arrive. EHDS strongly emphasizes data interoperability. Firely’s experience in FHIR standard implementation positions us to advise on future-proof system design that aligns with both EHDS expectations and ongoing EU standards evolution.
Organizational Readiness and Governance
EHDS isn’t just technical, it’s organizational. We advise on stakeholder alignment, clinical engagement and governance structures that will be essential for success.
As the healthcare landscape continues to evolve, payers must move beyond viewing FHIR as a regulatory checkbox and embrace it as a foundation for long-term transformation. Firely empowers health plans to adopt FHIR in a way that is scalable, secure, and aligned with business goals – without the need for disruptive overhauls. Whether you’re streamlining prior authorizations, enabling payer-to-payer data exchange, or meeting CMS mandates, Firely provides the trusted infrastructure and expert support to accelerate your interoperability journey with confidence.
